WECASHING TERMS AND CONDITIONS

Introduction

Welcome to Wecashing Services and application accessible at www.wecashing.com. The Application, and Services is owned and operated by " Wecashing ". These Terms of Service (“Terms”) govern governs both our products or services ("services"), users ("You, Clients or Advertisers") and your use of our application, such as the Wecashing.com mobile application (collectively, “Platform”), and your use of any contents, product, and service, collectively, “Services”) made available via the Application.

These Terms constitute a contractual agreement between you and us. By visiting, accessing, using, joining and/or participating in (collectively "using") the Wecashing Service, you express and acknowledge your acceptance and understanding of these Terms. As used in this document, the terms "you" or "your" refers to you, buyer, advertiser, any entity you represent, your or its representatives, successors and assigns, and any of your or their devices.

Please note that you will be required to review and agree to our Privacy Policy before you can access and use the platform. Advertisers who use the Service must accept and adhere to the Advertiser’s Terms and Conditions highlighted herein.

If you do not agree to be bound by these Terms, please don’t use the Service whereas.

Advertising Services Provided by us

Wecashing is an intermediary marketplace that brings together Advertisers and Users. We have developed the Service for users to advertise on our platform; you agree to be responsible for any action, offers, services and/or ads listing (each "Your Listiing" and collectively "Your ads listing"); you desire to own an advertising space or impressions for Your listing on our platform, applications and/or website operated by other users of the Service ("Third Party Users") and/or you want to publish advertising for Third Party Listings on Your ads space; we will grant you the use of the Service to own an advertising space and impressions through the Service in accordance with the terms hereof.

Therefore, in consideration of the valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties make the following agreement.

Important Disclaimers

All services rendered by the Wecashing are rendered “as is”, “as available” and “with all faults”, and the Wecashing disclaims all warranties, expressed or implied, including without limitation any guarantees regarding condition, quality, life duration, performance, accuracy, reliability, commercial value and suitability for specific purposes. All such warranties and liabilities are hereby excluded.
Wecashing has no control over and does not guarantee the existence, quality, safety or legality of goods and services published by users on the platform; the trustworthiness or accuracy of information provided by users in the announcements; the ability of advertisers to sell goods or to provide services; the ability of buyers to pay for goods or services; or that a user will actually complete a transaction. Wecashing makes no guarantees concerning that manufacturing, import, export, offer, displaying, purchase, sale, advertising and/or use of products or services, which are offered or displayed on the Wecashing platform do not infringe any third parties’ rights. Therefore, wecashing expressly disclaims any liability in connection to materials and information posted by users on the platform.

You are encouraged to check the item before payment and to request the advertiser to provide documents confirming compliance of the goods with applicable requirements of laws, regulations, rules, guidelines, standards.

You acknowledge that you are solely responsible for your safety and you understand that you should meet with other individuals for completion of a transaction only in safe public places in daylight hours. You are solely responsible for conducting due diligence of any individual or organization who listed an Advertisement on the Service. Wecashing disclaims any responsibility for user’s interaction with any individual or organization.

Advertiser's Supplement

The Service offers you the ability to own advertising space through the Service. If you use the Service to own advertising space (as an "Advertiser") you hereby acknowledge and agree that you agree to and will be bound by the Advertiser's Supplement, respectively, as they may be amended from time to time and which are incorporated herein by reference (together, the "Terms and conditions"). You acknowledge and agree that a breach of any provision in either of the guidelines is a breach of these Terms. Where these Terms and the Advertiser’s Terms conflict, these Terms shall control.

Eligibility for Access

By accessing and using the Service, you acknowledge and agree that you are over the age of 18 and are of legal age to form a legally binding contract with us. Please note that access to the Wecashing platform and Services are not available to users under the age of 18.

No Violation of Laws

You agree that you will not, in connection with your use of the Service, violate any applicable law, ordinance, rule, regulation or treaty. Without limiting the foregoing, you agree that you will not make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity).

Account Registration

If you decide to create an account on the Service and become a registered user, as part of the registration process, you will be required to submit certain personal information. Our Privacy Policy governs how we deal with your personal information. Please review the Privacy Policy carefully to understand our practices.

You are responsible for any activity that occurs with your account credentials so you are required to keep your account credential secure and out of reach from third-parties user.

Fees

To Advertise on the Platform is generally free; however, it may contain payable services. For instance, we may set limits for publishing advertisment in certain categories or offer advertising options for announcements on the Platform.

The fees we charge for using payable services and payment methods accepted by us are disclosed on the Platform. We reserve the right, in our sole discretion, to change the fees and acceptable payment methods from time to time and for any reason.

Unless otherwise explicitly provided by mandatory rules of the applicable law, the fees are non-refundable due to the nature of online services.

Sales and Purchases

All prices quoted include applicable sales taxes and levies in accordance with the law of the applicable jurisdiction. If you wish to enter into a transaction with an Advertiser, you may be asked to provide certain relevant information, and to verify these information. Verification of information may be required prior to the acknowledgment or completion of any transaction. By making a transaction, you represent that the applicable products and services will be used only in a lawful manner.

Please be aware that we do not directly collect credit card information from you, but through our authorized third-party payment processor, please refer to their privacy policy.

Account Suspension and Background Check

If one of your ad accounts gets suspended due to non compliance with one of our partners’ or our Advertising Policy, we can ask for additional documents to verify your identity and perform some background check to ascertain if we can re-enstate your account or terminate it. The required documents are, such as but not limited to; national ID and a utility bill. These are used for security purposes and identity verification.

You understand that we work closely with other third-parties who help to securely manage and process User Identity verification, receive, process and validate payment and credit/debit card information.

Third-Party Services

The Service may contain links to third-party Services that are not owned or controlled by Wecashing App. Wecashing App has no control over, and assumes no responsibility for, such Platform and online services. Be aware when you leave the Service; we suggest you read the terms and privacy policy of each third-party Platform and online service that you visit.

Copyright and trademarks
 
All the content on the Platform, including service marks, trade marks, designs, code, images, advertising content, advertiser identities, logos, property content, product information, general content, pricing data, advertisements, advertiser details, user interface design, software and all other forms of media or information published on the site from time to time (the “Content”) is owned or otherwise licensed by Wecashing App unless otherwise indicated, and, where applicable, is protected by local and international law on copyright and intellectual property.

You agree not to infringe on any of the intellectual property rights in the Content or any other material owned by third parties, and undertake not to reproduce the materials without the express permission in writing of the owners of the intellectual property rights. To obtain permission for the use of the Content on the Service, please email Support@wecashing.com.

Advertising Terms

You agree to have the legal capacity and you agree to comply with the following Advertising Terms below;

If you register yourself as a representative of a legal entity, you are authorized by the company to enter into an agreement with us and with users of the Platform;
You are above 18 years of age;
You will or have provided true, accurate, and complete information in your Account;
You will update your information on your Account to maintain its truthfulness, accuracy, and completeness;
You will immediately change data for access to the Platform if you have a suspicion that your Account access details were disclosed or probably used by the third parties;
You will notify the Wecashing of any unauthorized access to your Account;
You will not provide any false or misleading information about your identity or location in your Account;
You will use the Service in strict abidance by applicable laws, regulations, rules, guidelines;
You will not use the Service for any illegal or unauthorized purpose;
You will not post on the Platform listings that offer for sale or exchange any Prohibited or illegal Items.
You will not post on the Platform listings that infringe other person’s rights or interests, including any intellectual property rights or any other personal or proprietary rights of any third party.
You are solely responsible for the accuracy, quality, integrity, legality and intellectual property ownership or tight to us all Customer Data (as defined herein), and Shown shall not be responsible or liable for the deletion, correction, destruction, damage, loss or failure to store any Customer Data.
When you register as a company or corporate entity, You represent and warrant that Your company or corporate entity is properly incorporated or properly able to perform acts in law.
You must have the necessary ownership, licenses, rights or consents to submit Your Listings and Advertisements for inclusion in the Service and to use Your Listing and Advertisements in the Service.
You must own or have the necessary licenses, rights or consents to use all trademarks, copyrights, trade secrets or other proprietary rights in and to the content (including its domain name) on Your Advertisements.
Your Advertisements may not depict illegal activities, promote or depict physical harm or injury against any group or individual, or promote or depict any act of cruelty to animals.
Your Advertisements may not contain material that impersonates any person or entity or otherwise misrepresents you or Your listing in any way.
Your listing and Advertisements should not phish for information, mislead users, or include any content which forces users to take any action (warnings, locking notifications, etc.).
Your Advertisements should not contain or advertise torrents, "warez" or similar content.
Your Advertisements should not contain or advertise stolen scripts.
Your Advertisements should not promote or incentivize online activity to surf websites, click on ads or engage in any activity that artificially enhances website, advertiser or other metrics.
Your Advertisements should not promote the production of fake documents, the copying of materials or paper mills.
Your Advertisements should not promote drugs or any related paraphernalia.
Your Advertisements may not promote content that is targeted to anyone under the age of eighteen (18) years.
Your listings must have substantial real content and not simply be “blind links.”
Your Advertisements should not use any third party trademarks without appropriate authorization and may not create a likelihood of confusion for consumers or dilute any third party trademarks.

Listing or Advertisement Approval

All Listings or Advertisement are subject to our approval. We will not accept any Listings or Advertisements for inclusion in the Service unless you have our approval and your content and activities comply with these Terms and other restrictions that we may promulgate from time to time. If you have any questions about whether your Listings or Advertisements comply with these Terms, you may contact your online support manager via Support@wecashing.com.

You, Your Listing and Advertisements must satisfy all our conditions, as well as the other terms, conditions and restrictions contained in these Terms, and any other terms, conditions and restrictions as determined in our sole discretion (including any additional restrictions set forth in our own discretion).

Good Behaviour

We ask you both Advertisers and Buyers to be respectful to each other during your use of our Interaction Services. Avoid using foul language or creating a muss during Interaction. We reserve the right to terminate or suspend a user account, even after purchasing a product or services on the site. In these circumstances, no refund will be considered.

License we Grant you

You are entirely responsible for all materials that you upload, submit or make available via the Service, including advertisements (whether in the form of banners, pop-unders, pre-rolls, advertising copy, or otherwise) that you seek to place through the Service ("Advertisements"). Advertisements can not always be withdrawn. You acknowledge that any disclosure of personal information in Advertisements may make you or others personally identifiable and that we do not guarantee any confidentiality with respect to Advertisements (in fact, advertisements are likely to be published publicly on the Internet).
You shall be entirely responsible for any and all of your own Advertisements and any and all consequences of posting, uploading, publishing or making them available. For any of your Advertisements, you affirm, represent and warrant that.

We claim no ownership or control over Advertisements or Third Party Content. You or a third party licensor, as appropriate, retain all copyrights to Advertisements and you are responsible for protecting those rights as appropriate. You irrevocably grant us a worldwide non-exclusive license for an unlimited number of licenses, an unrestricted license that can reproduce, publicly perform and display, distribute, adapt, modify, translate, create derivative works and otherwise use an Advertising (including any registered trademarks ) for the purposes provided by the Service and these Terms.

You also provide other users of the Service with the right and license to use ads in connection with their use of the Service and/or the promotion/publication of your ads. You also resile from any claims and allegations of moral rights of attribution in relation to advertisements.

License you Grant Us

The foregoing license specifically includes a license by you to us to modify Advertisements as necessary for technical or commercial reasons, including scaling images, creating thumbnail images, shortening text to fit available space and any other modifications we deem necessary in our sole discretion to adequately provide the Service to you.

You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to Advertisements. Specifically, you represent and warrant that you own the title to the Advertisements, that you have the right to upload the Advertisements to the Service and to have them displayed through the Service, and that uploading and displaying the Advertisements will not infringe upon any other party's rights or your contractual obligations to other parties.

You acknowledge that we may at our sole discretion refuse to publish, remove, or block access to any Advertisement for any reason, or for no reason at all, with or without notice. Without limiting the other indemnification provisions herein, you agree to defend us against any claim, demand, suit or proceeding made or brought against us by a third-party alleging that your Advertisements or your use of the Service in violation of these Terms infringes or misappropriates the intellectual property rights of any third-party or violates applicable law and you shall indemnify us for any and all damages against us and for reasonable attorney's fees and other costs incurred by us in connection with any such claim, demand, suit or proceeding.

No Guarantees Of Availability

We give no guarantee to you of the continued availability of any particular property or product advertised on the Service and will not be liable to you should an advertiser have sold or withdrawn a Listing availability at any time prior to removal of the listing or resume from the Service.

Whilst we take efforts to ensure that advertisers and potential buyers are genuine and that the data presented about the Listing or buyer is accurate, we give no guarantee to you that every Listing or buyer description is free from errors or inaccuracies.

Children's Privacy Policy

Wecashing respects the privacy of children, and we are committed to complying with the European Union Children's Online Privacy Protection. This site does not knowingly collect, use, or disclose personal information from children under 18 without prior parental consent. However, we may provide our service to children under 18 years of age but under a parental guardian's supervision.

General Provision

After properly registering for the Wecashing Service, we grant you a personal, non-exclusive, fully revocable, non-assignable, non-transferable, limited right to use and access our services as permitted by us. As a user, you do not receive any ownership interest in the marketplace; you merely receive the right to use and access the Platform as provided by us. All rights not explicitly granted are reserved for Wecashing. You agree to abide by the following restrictions listed below:

Users may not accept payments using any method other than through Wecashing marketplace.
You may not exchange any contact details with Advertisers’ or any other means of communication
All contents must not violate any Copyright Laws
All communication and transaction must be carried out on the Platform.
You may not share your license with any other parties unless permitted by us in writing.
You may not violate any local or State laws, rules, or procedures.
You may not violate any of our additional policies.
You may not use our Platform except through specific channels provided by us.
You may not sell, lease, loan, distribute, transfer, or sublicense the Platform unless provided by us.
You are free to remove your content from the Platform at any time.
Depending on your Platform settings, if other users of the Platform have create new content (e.g. video content) or shared video content on third party services via the app, then that video content may be viewed and watched on the Platform or those third party services to earn points or rewards by Users.

Rewards & Points

You may be entitle to some payments in form of rewards and points provided by Wecashing especially when you watch videos, game ads or via affiliate links. Any payments you may be entitled to receive from Wecashing under any other agreement between you and Us (including for example payments under the Wecashing Affiliate Partner Program, Game Ads, Watched Video Rewards or Points) will be treated as royalties.  If required by law, Wecashing will withhold taxes from such payments.

Termination

Wecashing reserves the right to immediately suspend or terminate its Service to any User without warning and notice for violation or breach of any of the agreement in this Terms of Service.
 
Jurisdiction

These terms and the relationship between you and Wecashing is governed by the Supreme Court of Liberia; these Terms and all parties’ relationship will be defined as if you signed these Terms in Liberia, without regard to the Liberia conflicts of law rules. The parties agree to submit to The Supreme Court of Liberia and the European Union GDPR Laws. If you think the laws fail to satisfy the law of your jurisdiction, we should like to hear from you. However, ultimately it is your choice as to whether you wish to use our application.

Legal Guarantee

If you’re an EEA-based consumer, and you’ve agreed to our Terms and Conditions, then EEA consumer laws provide you with a legal guarantee covering the services that we provide you.

Your national laws may provide an even longer guarantee. Your rights under these legal guarantees aren’t limited by any other guarantees that we provide. If you want to make a guarantee claim, please contact us.

Your feedback

Wecashing encourages you to share your reviews and feedback with us, and we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better. By submitting feedback, you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide license (with the right to sublicense freely) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise.
